Terms of Service
These Terms of Service (“Terms”) govern your access to and use of SafefileMe at safefileme.com (the “Service”), including file uploads, shared download links, and related pages. By using the Service you agree to these Terms. If you do not agree, please do not use the Service.
Using the Service
SafefileMe lets users upload files and share them through download links. Anyone who has a link may be able to open the download page and download the file. You may use the Service only in compliance with these Terms and all applicable laws.
Eligibility
You must be at least 13 years old to use the Service. If you are under the age of majority where you live, you must have the permission of a parent or legal guardian. If you use the Service on behalf of an organization, you confirm that you have the authority to bind that organization to these Terms.
Accounts
Some features require an account. You are responsible for providing accurate information, keeping your credentials secure, and for all activity that happens under your account. Tell us promptly if you suspect unauthorized use. We may suspend or close accounts that violate these Terms.
SafefileMe is a partner service of SafelinkMe. Accounts are created and managed through SafelinkMe, and one account and dashboard cover SafelinkMe and its partner services. When you use SafelinkMe you must also follow its own terms.
Your Content
You keep ownership of the files and information you upload (“Your Content”). You grant SafefileMe a worldwide, non-exclusive, royalty-free license to host, store, copy, transmit, and display Your Content only as needed to operate, secure, and improve the Service and to make files available through the links you create.
You are solely responsible for Your Content. By uploading a file you confirm that you own it or have all the rights and permissions needed to upload and share it.
Prohibited Uses
You may not use the Service to upload, share, or link to any of the following, or to engage in the following activities:
- Content that is illegal or that infringes copyright, trademark, or other intellectual property rights.
- Child sexual abuse material or any content that exploits or endangers minors. We have zero tolerance for this content and report it to the appropriate authorities.
- Malware, viruses, ransomware, spyware, or any file designed to damage systems or gain unauthorized access.
- Phishing, scams, fraud, or other deceptive content.
- Non-consensual intimate imagery, doxxing, harassment, threats, or content that incites violence or hatred.
- Personal data of other people without their authorization.
- Content that promotes terrorism or violent extremism.
- Attempts to bypass limits, verification steps, wait timers, or access controls, or to scrape, overload, probe, or disrupt the Service.
- Generating artificial downloads, views, or clicks, or manipulating advertising or any earnings program.
- Using the Service to host assets for embedding or hotlinking on other websites without our permission.
Download Pages and Advertising
Download pages may include verification steps, waiting timers, and advertisements. Advertisements may be provided by third parties, may open in a new tab or window, and are not endorsed by SafefileMe. We are not responsible for the content or practices of advertisers or the sites they link to, so please use caution with anything you open through an ad.
Files shared through the Service are provided by users. We do not guarantee that any file is safe, accurate, or lawful, and you download files at your own risk.
File Storage and Retention
We may set limits on file size, storage, bandwidth, and how long files are kept. Files that are inactive, expired, or in violation of these Terms may be deleted without notice. We do not guarantee that Your Content will be stored indefinitely or be recoverable, so please keep your own backups.
Copyright and Reports
We respect intellectual property rights and respond to notices that comply with our DMCA Policy. Anyone can report a file using the Report file option on a download page or by contacting dmca@safefileme.com.
Enforcement
We may investigate violations, remove content, restrict access, suspend or terminate accounts, and cooperate with law enforcement, in each case at our discretion and with or without notice. We are not obligated to monitor content, but we may review it to enforce these Terms and to protect the Service and its users.
Paid Features and Programs
If we offer paid plans or earnings programs, additional terms will be presented to you and will form part of these Terms. Where fees apply, they will be shown before you pay and may be non-refundable except where the law requires otherwise.
Third-Party Services and Links
The Service may contain links to, or integrations with, third-party services such as verification providers and advertisers. We do not control these services and are not responsible for them. Your use of them is subject to their own terms and policies.
Termination
You may stop using the Service and delete your account at any time. We may suspend or end your access at any time, particularly if you violate these Terms. Provisions that by their nature should continue after termination, including the disclaimers, limitations of liability, and indemnification, will survive.
Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that files available through it are free of malware or other harmful components.
Limitation of Liability
To the maximum extent permitted by law, SafefileMe and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or revenue, arising out of or related to your use of the Service.
Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim arose or US$50.
Indemnification
You agree to defend and hold harmless SafefileMe and its operators from any claims, damages, and expenses, including reasonable legal fees, arising from Your Content, your use of the Service, or your violation of these Terms or the rights of others.
Changes to These Terms
We may update these Terms from time to time. When we do, we will post the updated version here and change the date at the top. If you keep using the Service after changes take effect, you accept the updated Terms.
Governing Law
These Terms are governed by applicable law. Disputes will be handled by the competent courts, unless the law where you live requires otherwise.
